General Terms of Use for the Tabakerya.com Platform. Applies to all regions served.

Tabakerya.com (the “Platform”) is a multi-vendor digital marketplace that facilitates commercial transactions between third-party sellers (“Vendors”) and buyers (“Customers”). The Platform acts exclusively as a technological and commercial intermediary. The sales contract is concluded directly between the Customer and the Vendor.
Access to the Platform and use of the services are allowed only to persons with full legal capacity. Considering the nature of the products being marketed (tobacco, alcohol), placing orders is strictly prohibited for minors (under 18 years old). Upon delivery, the courier or vendor may request identity verification. Failure to comply with this restriction will result in immediate order cancellation and account suspension.
The prices displayed include applicable taxes in the selected delivery region. The platform reserves the right to correct obvious typographical errors in pricing before confirming the delivery. An order becomes final only after the Vendor confirms stock availability and generates the AWB. Products are subject to real-time availability; in case of unexpected stockout, the Customer will be notified and fully refunded.
The platform offers payment options tailored to the local market, including Cash on Delivery (COD) and Bank Transfer. By using the COD method, the customer agrees to pay for the package at the time of physical handover. The platform does not store sensitive payment data. All financial transactions are processed through authorized partners and comply with PCI-DSS standards.
Since Tabakerya is a marketplace, a single order can generate multiple packages shipped by different Vendors. Each package has its own shipping cost and delivery time. The risk of loss or damage to the goods transfers from the Vendor to the Customer at the moment of actual handover to the courier or directly to the Customer, in accordance with applicable international commercial laws.
Customers are entitled to a standard 14-day return period for undelivered products. Universal Exception: Sealed tobacco products, opened alcoholic beverages, or hygienic consumables cannot be returned after unsealing for sanitary safety reasons. The vendor is responsible for managing returns and refunds, with the Platform only facilitating communication.
All visual elements, logos, and source code of Tabakerya.com are exclusive property. Reviews, photographs, and comments posted by Users remain their property, but they grant the Platform a non-exclusive, global, and free license to use them for promotional purposes. False, defamatory, or illegal content will be immediately removed.
The platform makes reasonable efforts to ensure the accuracy of information, but does not guarantee the absence of technical errors. Tabakerya.com is not responsible for product quality, delivery term violations by Vendors, or major force majeure events. Our liability is limited to the value of the commissions collected for the respective transaction.
These terms are governed by the general principles of international electronic commerce. Any dispute will be resolved primarily through amicable means. In the absence of an agreement, jurisdiction belongs to the courts in the jurisdiction of the Platform's registered office, in accordance with applicable European (Brussels I bis) or international regulations.
We reserve the right to modify these terms to reflect legislative or operational changes. Users will be notified via email or a banner on the site at least 30 days before significant modifications take effect.
